General rental terms and conditions
Version 1 · 19 October 2026
These terms apply to every rental contracted with Maison Aurea Events, S.L. (tax ID B93870822; the company's full details are in the Legal notice). They form part of every offer: by accepting the offer, the Client accepts them. Where the law requires it, they distinguish the private client (consumer) from the professional client. In case of divergence, the Spanish version prevails.
1. The offer and the booking
The offer lists the pieces and their quantities, the price of each line, the replacement value of each piece, transport, set-up, the security deposit and the date until which it is valid.
The booking is made when the Client accepts the offer and Maison Aurea receives the advance payment. Only from that moment is the equipment held for the date of the event: before that, nothing is reserved.
Changes (date, quantities, pieces) are agreed in writing and give rise to a new offer, subject to the availability of the equipment.
2. Prices
All prices are in euros. For private clients, the prices in the offer include VAT: the stated price is the final price. For professional clients, prices are stated excluding VAT, which is added at the current legal rate.
Transport, according to the zone, and the setting of the table by our team each have their own rate and appear in the offer, each on its own line. No amount is ever added that does not appear in the offer.
3. Payments
- The advance payment shown in the offer is paid on accepting it and holds the equipment.
- The rest of the amount, security deposit included, is paid in full forty-eight (48) hours before the day of the event at the latest. The offer and the invoice state the deadline.
- Payments are made by bank transfer to the account shown in the offer or invoice, quoting its reference.
Until full payment has been received, Maison Aurea is not obliged to deliver the equipment.
4. Security deposit
The security deposit is twenty-five per cent (25 %) of the offer total including VAT, unless the offer states otherwise or no deposit was agreed. It is outside the taxable amount: it is not a price, it is a guarantee.
Maison Aurea refunds it after receiving the equipment and recounting it at its warehouse, less any breakage and missing items (clause 10), within seven (7) calendar days of the recount. If breakage and missing items exceed the deposit, the difference is invoiced separately. Without a deposit, breakage and missing items are invoiced in full.
5. Advance payment and cancellation
Private client. The advance payment is made as a penitential deposit (arras penitenciales, article 1454 of the Spanish Civil Code). If the Client cancels the booking, at any time, the advance payment is forfeited. If Maison Aurea cancels the booking for a reason attributable to it, it returns twice the advance payment. All other amounts paid, including the security deposit, are refunded in full within fourteen (14) calendar days.
Professional client. The previous paragraph applies. In addition, if the professional Client cancels fewer than seven (7) days before the day of the event, it pays the offer total as a penalty clause, less the advance payment. The security deposit is always refunded.
Cancellations are made in writing, by email or by WhatsApp.
Force majeure. If the event cannot take place for a reason beyond both parties' control that could neither be foreseen nor avoided (for example, a ban by the authorities), the parties look for a new date together; if that is not possible, Maison Aurea refunds the amounts paid.
6. Right of withdrawal
The contract is a rental, transport and set-up service linked to an event on a fixed date. The right of withdrawal from distance contracts therefore does not apply (article 103, letter l, of Spanish Royal Legislative Decree 1/2007).
7. Delivery, set-up and collection
Maison Aurea delivers the equipment to the agreed place within the agreed time slot; when set-up appears in the offer, our team lays the table. The Client guarantees access to the venue and a space to leave the equipment.
Collection takes place the morning after the event or, if requested, the same night. The equipment is left together at the place of delivery, in our crates, and the linen in its bags. Maison Aurea does not count at the venue: the count is made at its warehouse (clause 10).
8. Custody and use
From delivery to collection, the Client has custody of the equipment and is responsible for it, including what its guests, its catering service and the venue staff do. Theft and weather damage to equipment left unattended are at its expense. Normal wear is never charged; a drop of wax from our candleholders is normal use.
9. Washing
For private clients, we take care of the washing: the equipment is returned as it is, without rinsing. For professional clients, washing is an option in the offer; without it, the equipment is returned free of food remains.
10. Count, breakage and missing items
Maison Aurea counts the equipment at its warehouse after collection, with photographs. For private clients, the count made at our warehouse, documented with photographs, is evidence of breakage and missing items; for professional clients, it is final.
Each broken, lost or irreparable piece is charged at its replacement value, as shown in the offer for that piece; a repairable piece, at the cost of repair. Maison Aurea informs the Client of the result of the count in writing, with the photographs. Private clients may submit their observations in writing and see the photographs and the pieces, and always keep their right to turn to the consumer services and the courts.
A piece that is not returned is reported to the Client; if it does not turn up, it is charged at its replacement value.
11. Experiences and chefs
When an Experience involves cooking, the chef is an independent professional who contracts and invoices the culinary service directly to the Client. Maison Aurea takes no part in that contract, receives no amount for it and is not liable for its performance.
12. Personal data
Maison Aurea processes the Client's data to prepare the offer, carry out the rental and invoice it, in accordance with its Privacy policy.
13. Languages and versions
These terms are published in Spanish, English and French. In case of divergence between versions, the Spanish version prevails. Each booking keeps the version and language of the terms in force on the day of the booking.
14. Applicable law and complaints
Spanish law applies. Private clients may go to the courts of their place of residence and have complaint forms (hojas de quejas y reclamaciones) available. With professional clients, the parties submit to the courts of Marbella.
